The provisional stability of pregnant employee and the coherence dialogue: a phenomenological understanding

Abstract

The present article proposes to analyze the aspects related to the provisional stability of the pregnant employee in contracts for a determined period in the light of the contractual principles structuring civil law. Based on the theory of the dialogue between the sources of labor law and civil law, the article will aim, through the use of the phenomenological method of research, to carry out a re-reading of the institute of the provisional stability of pregnant women in fixed-term employment contracts of contractual principles, such as subjective good faith, autonomy of the will and compulsory force of contracts, in order to establish the limits of this temporary stability in employment.
