La responsabilidad solidaria en la subcontratación laboral. Algunas consideraciones sobre su naturaleza y sus efectos

Abstract

Article 183-B of the Labor Code addresses that the «the main company is jointly liable for the labor and social security giving obligations that affect the contractors in relation ro their employees>>. Athough this reference ro a joint liability seems ro refer directly to the concept and status of joint obligations of the Civil Code, such reference cannot be easily made because of the possibiliry opened by the labor legislator of dividing the debt berween the co-debtors of the employer and also by the necessity for cause a passive «litisconsorcio>> or joint litigation with him, ro enforce with this the liability of the co-deptors. lt is concluded that the solidarity addressed in Anide 183-B of the Labor Code is sui generisand thus, the determination of its effects requires huge dogma tic efforts.
