A defense of the judgment Gonzáles Lluy vs. Ecuador delivered by the Inter-American Court of Human Rights

Abstract

The main goal of this article is to roughly defend the reasoning followed by the Inter-American Court of Human Rights in the case of González Lluy v. Ecuador. The paper will be structured according to the following order: first, we will describe the facts of the case. In second and third place, we will analyse and asses the way in which the Court used, on the one hand, the argument regarding stereotypes and, on the other, the proportionality test. Next, we will consider and refute the objection regarding the use of the proportionality test based on the notion of minimum content of social rights. Finally, we will present our conclusions as a summary.
